On the morning of our first appearance in court, Mr. Jacobson appeared shocked and dismayed at our appearance when presiding judge called the case number and I responded as the representative of Andisheh Corporation. Mr. Jacobson's demeanor was clearly out of sync since he had expected to receive a "False Summary Judgement" on that day. Andisheh Corporation would have become a debtor for a large sum of money (claimed debt $11,000 and change + Costs + expenses + Antony's Fees + attorney's Fees reserve). I submit to you he was angry.

When we were motioned to discuss the matter by Judge Shutter, he immediately asked. "who are you?" After introducing myself, I asked the same and SURPRISE .... I am Mr Jacobson. When I inquired as to the whereabouts of Mr. Stein, he told me that he was the lawyer on this case. When asked about why Mr. Stein was not there, he responded that he was the lawyer not Neil Stein. I asked why he had lied to me about his position? I was looked down at, sized up, and told with a smirk on his face, " I guess I'm going to have to have a talk with him". I told him, "why don't you and I walk to your offices and we will both have a talk with him". He laughed at me and said, "that's not going to happen". I dropped the issue then, but now it is another matter.

I followed by asking why i had not been sent a letter confirming the receipt of documentation faxed? to my surprise, Mr. Jacobson denied having ever seen our faxes. I asked, "are you telling me that you have not seen our documents faxed to you at least two weeks ago?" That is what I am telling you, he responded, Let me see what you have there while pointing to the folder in my hand. I showed him the documents, and his immediate - took 10 to 15 seconds - response was that, "you can not sell a business like that. i asked what makes you say that? he replied, "I AM A LAWYER AND I KNOW THESE THINGS, AND YOU ARE NOT". I told him that we had in fat sold the business and we had nothing to do with their claims.

Following a few more verbal exchanges (see case Synopsis), He looked at me again, clearly dismayed at not being able to receive a false judgment that day, and declared, " I think we are going to prosecute this case, threw my folder back at me, turned around and started walked away". After gathering my belongings, I caught up with him and the lady lawyer with him, and told them, "you live in a world of your own making". They walked off, and I did not see or talk with anyone at JSM till I was forced to appear in the court again.

I assure everyone reading this, "It is infuriating to be told lies in a legal setting". This will not be tolerated by Andisheh Corporation.

Upon returning from the court, I set out to write a letter detailing my exchange with Mr. Jacobson. I had hoped to end the lawsuit by writing the judge and explaining the insanity of the situation. I mailed my response of the events of that day to Judge Shutter and Mr, Jacobson. Instead of accepting and admitting that an error had occurred he filed a motion to STRIKE my response form court proceedings and consideration, forcing me to appear again in the court.

On this occasion, he set out to "Set a Trap" for me personally.When our case was called, he proceeded to tell the judge that he objected to my response on the grounds that, "I am not an attorney", and as such not allowed to represent Andisheh Corporation. He spiced things up by telling the judge that he had in fact had a conversation with me, and told me the same plus some additional factual points about the case. The big finally came when he told the judge that I had got mad at him, shouted at him, and had called him RUDE, and used Foul Language with him. That prompted the Judge to give me his version of a proper conduct speech. When i tried to say, "We are not involved with this matter", the judge saw that in the context Mr. Jacobson had created, an took it as if I was trying to interrupt him. He promptly called the bailiff and had me escorted out of the court room before as he said, "I get myself into more trouble" that day.

Mr Jacobson was clearly jubilant as to his effective cover up of the facts of the case and maliciousness. See footnote below from Case Synopsis. Andisheh Corporation was given ten (10) days to respond via an attorney, and that started out a five (5) year litigation, causing us untold grief, anger, Wasted time, loss of economic activity, income, and $10,000 or more in actual attorney's fees plus a great deal of economic loss.

I had never had a conversation with him, never called him rude, or anything else. His behavior can only be explained by HATE. It is Ethnic, and Racial Hate that leads people to ignore the facts, try to cover them up, and create unnecessary grief and expense for others. All this, because he is a LAWYER and I AM NOT. Not so fast, I think NOT. This is not about lawyers and engineers. It is about Power and Control. A court may have been his realm at the time, but as of now (2008), we are going to get to the bottom of this matter.

From Case Synopsis:

During our second court meeting (to strike my truthful response from the record), Mr. Jacobson lied to the judge on his behalf, on my behalf, and on behalf of the case and documentation submitted. Furthermore, he asked to have relevant evidence excluded from the case. By lying to the judge, he tried to set me up to be arrested and jailed; knowing full well the judge can not let me speak on behalf of Andisheh Corporation. I was ordered, and escorted out of the courtroom by bailiff, since an officer of a company can not represent the company. All I wanted to say was, “we sold the company 4 years prior to date of these invoices”.

Andisheh was forced to hire counsel and incur over $10,000 worth of le gal fees over the years.

On the occasion of our next court appearance, Jacobson did not show up (perhaps embarrassed, and instead Mark Rickard made his first of many appearances. As we were waiting in the hall, Our lawyer motioned his way and told me about the new lawyer. I sensed perhaps it would be appropriate to start on a positive note with him, I walked over and extended my hand and said, "Hello". His tone and manner was so FOUL that my attorney had to intervene and WARN Mr. Rickard to address me in civil tone and language or he will not let him have a conversation with me. He just looked over with glassy eyes and laughed.

When our case was called, he immediately went on to say, "now that the DEBTORS in this case are represented, we want a summary judgment and a conclusion to this case". It does not matter that they sold the business (accepting what Jacobson had declared an Illegal Sale), they are still responsible because they never notified our client of the sale. BIG LIE from Rickard on his first appearance. His Lie number one (1) proven a lie. See Attachment ? (Marketing Mailer clearly shows Synnex knew us as Andisheh not MBCC)

Although that strategy (Legal Position) worked for them for a while, They had to resort to other lies to keep aggravating us. These lawyers did not miss a chance to act on their Racial and Ethnic hate for five (5) years.

Over time Misers Jacobson, Rickard, two other male lawyers, and two female lawyers (one was the woman accompanying Jacobson on first appearance) made their way into the court for a variety of motions and innuendos and delay tactics.

On one occasion they asked for the case to be transferred to California. They sued in Florida, however since they could not get anywhere with their lies here, they tried to make it hard for us to defend against their lies by moving the venue 3000 miles away, to Silicon Valley, California.

On another, they asked to have the deposition take place over the phone. when denied, they asked for a MAGISTRATE to review the case and second guess the presiding Judge's order. That prompted me to laugh out loud at the stupidity and viciousness of the se lawyer. I wrote a letter to five (5) of Synnex's executive management without the dignity of a response.

When we met for mediation, Mr. Rickard got so angry at his position and himself, that he said, " Even if a notice was filed with Synnex, it was filed with the wrong person inside synnex. It is the customers responsibility to notify the right person, and if they had any legal training or understanding, they would know that". That prompted me to respond to the mediator, and Mr. Rickard as follows:

To Rickard: Oh I get it, I do not have Jurist Doctorate, so I must be Clueless?

And then to Mediator: I guess we now know the whole argument about filing a notice of business sale was just resolved, since he just admitted a notice was in fact filed with Synnex, except that perhaps it was not filed with the right individual, which prompts the next question. Why don't either of you gentlemen tell me, who that person is? Right Now! Synnex representative, and Rickard were both dumbfounded, and we never received a response.

From the begining, Andisheh has sought to conclude this matter in an equitable, and fair manner. However, Synnex through its lawyers has refused to even dignify our requests on five (5) occasions.

1. We agreed to submit documents, and receive a letter containing two (2) paragraphs.One to accept documents, and second to end the matter.

2. We asked for a conclusion to the case prior to hiring an attorney, due to pending legal fees.

3. We asked for them to pay attorney's fee of a few hundred dollars upon hiring lawyers.

4. We asked (during mediation) for conclusion and payment of our Attorney's fees.

5. We asked for attorney's fees and a small token amount for time and expenses when JSM bailed out of the case.

We were only offered our attorney's fees with many conditions attached. We refused all conditions on two or more occasions and finally received most of our attorney's fees, without any consideration for all the losses Synnex had caused by that time.

We are now suing to set the record straight, and recover an untold amount of damage to our business, and person. There are many other aspects to this case that this venue is ill equipped for discussion. More in our www.synnexsucks.com BLOG.
